Terms of Service

These Terms of Service ("Terms") govern your use of the website lasama.com (the "Site") and your purchase of products from LaSama ("we", "us" or "our"). By visiting the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who we are

2. Using the Site
You must be at least the age of majority in your province or country of residence to place an order. You agree to use the Site only for lawful purposes and not to interfere with its operation, attempt to gain unauthorized access, or copy, scrape or redistribute its content.

3. Products and descriptions
We make every effort to display our jewelry accurately. Because our pieces are handcrafted and use natural materials, small variations in colour, finish, stone characteristics and dimensions are normal and are part of what makes each piece unique. Screen settings may also affect how colours appear. Such variations are not defects.

4. Custom, bespoke and personalized pieces
Custom, bespoke, engraved and personalized pieces are made to order to your specifications. Once production has begun they cannot be cancelled, changed, returned, exchanged or refunded. Please check all details (sizes, initials, engraving text, spelling) carefully before confirming your order. Production timelines are estimates and will be confirmed by email.

5. Orders and acceptance
Placing an order is an offer to purchase. We may accept or decline any order at our discretion, including where a product is unavailable, where we identify a pricing or listing error, or where we suspect fraud. Your order is accepted only when we send a shipping confirmation. If we cancel an order after payment, we will refund you in full.

6. Prices and payment
All prices are in Canadian dollars (CAD) unless stated otherwise. Applicable taxes and shipping charges are calculated and shown at checkout. We may change prices at any time, but changes will not affect orders already accepted. Payment is processed securely through Shopify Payments and the payment providers shown at checkout. We do not store your full payment card details.

7. Shipping
Shipping is governed by our Shipping Policy. All orders are shipped insured with tracking. International customers are responsible for any duties, taxes and customs fees charged by their country. Risk of loss passes to you on delivery.

8. Returns and refunds
Returns, refunds and store credit are governed by our Return and Refund Policy. In summary, ready-to-wear pieces may be returned within 14 days of delivery in unworn, undamaged, original condition. Custom, bespoke, engraved and personalized pieces, earrings, and sale items are final sale.

9. Care of your jewelry
Fine jewelry should be handled with care. Avoid contact with water, perfume, cosmetics and harsh chemicals, and store pieces separately. Damage caused by wear, accident, improper care or alteration by a third party is not covered as a defect.

10. Intellectual property
All content on the Site, including designs, product names, photography, text, graphics and logos, belongs to LaSama or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute or create derivative works from any Site content without our prior written permission.

11. User content
If you submit reviews, photos, comments or other content to us or tag us on social media, you grant LaSama a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with our business. You confirm that you own the content and that it does not infringe anyone else's rights.

12. Third-party links and services
The Site may contain links to third-party websites or use third-party services. We are not responsible for the content, policies or practices of any third party. Your use of third-party services is at your own risk.

13. Accuracy of information
We work to keep information on the Site current and accurate, but we do not guarantee that it is free of errors or omissions. We may correct errors and update information at any time without notice.

14. Disclaimer
The Site and its content are provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties, express or implied, regarding the Site, other than those set out in these Terms or that cannot be excluded under applicable consumer protection law.

15. Limitation of liability
To the fullest extent permitted by law, LaSama and its owners, employees and suppliers are not liable for any indirect, incidental, special or consequential damages arising from your use of the Site or purchase of our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits any rights you have under the Consumer Protection Act, 2002 (Ontario) or other applicable law that cannot be excluded.

16. Privacy
Your personal information is handled in accordance with our Privacy Policy.

17. Changes to these Terms
We may update these Terms from time to time. The current version is always posted on the Site, and the date of the last update is shown below. Continued use of the Site after changes are posted means you accept the updated Terms.

18. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute will be resolved in the courts of Ontario, without prejudice to your right to bring a claim in your local jurisdiction where consumer protection law so provides.
